How do I know if I can apply?

You must be separated for at least two years, and either you or your spouse must be resident in the state for the preceding 12 months. If you have any children, there must be arrangements in place for their care. There must also be no chance of you and your spouse reconciling.

But don't worry; after you submit your application, we will review it to ensure you meet the minimum legal requirements.

What information do I need to provide?

You will have to provide details about your marriage. So, questions like when you got married, where you got married and when you separated. You will also have to provide information on where you lived when you married.

In addition to details about the marriage, you will have to provide information on your financial position. All divorce Applicants must submit is an Affidavit of Means as part of their application. An Affidavit of Means is a document that sets out all your assets, liabilities, incomes and outgoings.

If you have dependent children with your spouse, you will also have to provide information about the arrangements for their care.

What documentation will I need to provide?

Any documentation you need to provide to us can be uploaded directly to your account. No need to post or email.

All applicants will have to provide their marriage certificate.

If you have a pension and are getting a pension adjustment order, you will have to provide us with a recent Pension Benefit Statement.

The only other documentation you may need to provide to us would be any agreement about your separation, such as a copy of your separation agreement.

How long will it take to complete the Easydivorce application?

We have spent a lot of time making the application as straightforward as possible to complete. So even if you have a lot of information to provide, it should not take longer than 15 mins.

What happens after I submit my application?

After you have registered and answered all necessary questions, we will review your application. Usually, we will revert within 24 hours with documentation for you to review and a request for payment so that we can get started!

The Divorce Procedure

How long is this going to take if I use EasyDivorce?

The length of time your divorce takes depends on several factors.

The courts are closed over certain periods of the year when no divorce hearings take Place, so this can cause delays.

It's also crucial that your spouse co-operates and returns a signed consent form as quickly as possible. Failure of your Spouse to co-operate can result in significant delays.

As a general rule of thumb, on average, a divorce application takes approximately four months from the point at which your application is submitted to the courts to when you obtain your divorce.

What will I need to do?

You will need to print out documentation and get it signed when required.

When it's time to serve the divorce paperwork to your spouse, you will have to do this by either by registered post or handing them the documentation.

Finally, you will need to attend court on the day of your divorce hearing when your divorce will be finalised.

What does my spouse need to do?

Your spouse will need to sign a document consenting to the divorce and will also be required to submit an Affidavit of Means.

It is also important for your spouse to attend court on the day of the divorce hearing. The judge will expect both parties to be present on the day, with some exceptions, for example, where one party is living abroad.

What if my spouse ignores everything?

It's not ideal as it will add significantly to the length of the procedure and may take up to one year for your divorce to be finalised.

However, ultimately as long as your spouse does not contest the application, your divorce will be granted.

If your spouse does contest the divorce for any reason, we will not be in a position to assist you.

How will I know what to do?

We will be in regular contact throughout the process with clear instructions on what to do. If you need help at any stage of the process, phone and email support is available.

And don't worry, we keep a constant track of our applications, so if you forget to do something, you will get a text reminder.

Technical Support

I started my application a long time ago, can I recontinue?

As long as it's been less than 12 months, you can log in with your registration details. If it's been longer than 12 months since your account has been active, your personal information will have been deleted for data privacy reasons.

I can't upload my documentation for some reason?

Don't worry; if you have an issue uploading documentation, just drop us an email, and we will get back to you straight away.

Eligibility

Who can apply for a DIY Divorce?

Anyone who meets the minimum legal requirements – that you are separated four years, one party has been resident in Ireland for the last 12 months and that there is no prospect of reconciliation.

Do I need to have a separation agreement?

No – but you must be able to satisfy the courts that you have been separated for 4 of the last five years.

Do separate bedrooms constitute living apart?

Yes and No. Separate bedrooms is one of several factors considered when determining if a couple are living separate and apart from one another. Other factors include operating separate bank accounts, separate tax returns, not sharing meals etc. The most important factor is whether the decision to remain in the same house was one of necessity or one of mutual convenience.

Do I need proof that I have been separated for two years?

In most cases, this will not be necessary. However, in circumstances where you and your spouse continue to reside in the same house, it's possible the courts may look for some proof.

What if my spouse lives abroad?

You can still obtain your divorce provided you know where your spouse lives. Additional paperwork is required if your spouse lives abroad, and the procedure can take longer than if your spouse was resident in Ireland.

Can I get a divorce if I was married abroad?

Yes – as long as you are resident in Ireland. However, you must have an original marriage certificate. If the marriage certificate is in a foreign language, it must be translated by an official translator – typically, this costs in the region of €50.

What if I do not know where my spouse lives?

Easy divorce will only process applications where the address of your spouse is known. If you cannot locate your spouse, please contact us, and we can discuss if we can assist.

What court will the divorce application be heard in?

In most circumstances, the court will be the circuit court in the county where the Applicant normally resides or is employed.
